END USER LICENCE

The following agreement applies to the HFFL Service provided by HFFL.

This is a legal agreement between you, either an individual or an entity, as the end user ("the Recipient") and Healthy Food Media Pty Ltd  ("HFFL"). By using the service provided to you by HFFL ("Service"), you agree to be bound by the terms of this agreement ("the Agreement").

1. GRANT OF LICENCE

HFFL grants the Recipient a limited, non-exclusive, non-transferable licence to use the Service. HFFL shall retain title and all ownership rights to the Service.The Service may ONLY be used in accordance with the terms and conditions of this Agreement.

2. TERM OF AGREEMENT

The term of this Agreement shall commence at the date Recipient registers with HFFL.

3. MAINTENANCE

HFFL is not obligated to provide maintenance or technical support to Recipient for the Service licensed under this Agreement.

4. INTELLECTUAL PROPERTY
All intellectual property rights are owned by HFFL.  Intellectual Property means all industrial and intellectual property in and to the HFFL and documentation including all copyright, trademarks and other service marks (registered or unregistered), business names, designs, patents, source code,  object code and other computer language information which enables source code or object code to be altered into relevant language.

5. CONFIDENTIALITY

The Service, including its existence and features is confidential information and is the sole and exclusive property of HFFL.  The Recipient agrees not to disclose or provide any part of the Service, documentation or information relating to the Service to a third party without HFFL express written permission.

6. DISCLAIMER OF WARRANTIES

(i) The content and information on this website is provided "as is" and without  warranties of any kind, either express or implied .  
 
(ii) The content and information on this website is altered periodically and changes in circumstances after information is placed on this website may affect the accuracy of the information. It is your responsibility to assess and verify the accuracy, completeness and reliability of the information contained on this website. 
 
(iii) HFFL makes no warranties or representations express or implied regarding the quality, accuracy, completeness, timeliness, merchantability or fitness for purpose of any content or information on this website or product referred to on this website. 
 
(iv) HFFL makes no warranties that this website is free of human or mechanical error, technical inaccuracies or typographical errors.  
 
(v) HFFL makes no warranties or representation that the content on this website will not cause damage or that the content is free from any computer virus or any other defects or errors or omissions and refers to the Limitation of Liability section below.  
(vi) The information given on this website and in the HFFL books and DVDs should not replace any advice given to you by a doctor or dietitian. Please seek medical advice before making any changes to your diet.

7. EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES

HFFL shall not be liable for any loss of business, loss of use of data, 
interruption of business, lost profits or goodwill, or other indirect, special, incidental, exemplary or consequential damages of any kind arising out of this Agreement and in connection with the service even if HFFL has been advised of the possibility of such loss. This exclusion excludes any liability that may arise out of third party claims made against the Recipient.

8. LIMITATION OF LIABILITY AND REMEDIES

To the maximum extent permitted by applicable law, any liability of HFFL will be limited exclusively to a refund of the applicable Service fee.

9. CREDIT CARD FACILITY

Any credit card transactions in connection with the Service are conducted via a facility supplied by the existing Internet credit card providers.  HFFL shall not be liable for any loss or damage suffered by Recipient in connection to the use of such Internet credit card facility.

8. GOVERNING LAW AND JURISDICTION

The law of this Agreement is the law of Victoria.  The parties irrevocably and unconditionally submit themselves to the exclusive jurisdiction of the courts of Victoria or courts having jurisdiction in Victoria and of all courts competent to hear appeals from these courts.  The parties waive any right to object to any proceedings being brought in those courts.
